This Privacy Policy and Personal Data Processing Policy defines the procedure for collecting, using, storing, transferring and protecting information of users of the Minatrix.FM / Minatrix platform.

This Policy applies to the websites minatrix.fm, minatrix.com, minatrix.com.ua, their subdomains, localized versions, Minatrix.FM mobile applications, related services, pages, features and interfaces through which the User accesses the platform.

By using the Service, creating an account, uploading materials, sending messages, using paid features, signing in through third-party services, or continuing to use the Service after this Policy has been updated, the User confirms that they have read this Policy.

1. General Provisions

1.1. Minatrix.FM is an online music platform that provides access to online radio, music content, artist and DJ profiles, user-generated materials, comments, messages, ratings, playlists, news, promotional tools, Premium features and other functionality.

1.2. Some features of the Service are available without registration. Access to certain functions may require the creation of an account.

1.3. The Operator processes personal data only to the extent necessary for the operation of the Service, performance of the User Agreement, ensuring security, communication with the User, compliance with legal requirements and development of the platform.

1.4. The Operator does not sell Users’ personal data.

1.5. This Policy is a public document and is made freely available on the Service.

2. Key Definitions

2.1. Personal data means any information that directly or indirectly relates to an identified or identifiable User.

2.2. Processing of personal data means any actions performed with personal data, including collection, recording, storage, clarification, use, transfer, depersonalization, blocking, deletion and destruction.

2.3. User means any person who visits the Service, creates an account, listens to radio, uploads materials, uses the application or otherwise interacts with Minatrix.FM.

2.4. Account means the User’s account on the Service.

2.5. User Content means music, DJ sets, remixes, podcasts, images, cover artworks, avatars, descriptions, comments, messages, reactions, profile data and other materials posted by the User on the Service.

3. What Data the Service May Process

The Operator may process the following categories of data.

3.1. Account Data

  • name, nickname or display name;
  • email address;
  • login;
  • password in a technically protected form;
  • avatar, profile photo, cover images;
  • interface language;
  • country or region, if provided by the User or determined by technical means;
  • registration date;
  • account settings;
  • account status, Premium status, internal points, BPM, limits and history of use of certain features.

3.2. Authorization Data Received Through Google and Other Third-Party Services

When signing in through Google or another third-party service, Minatrix.FM may receive data necessary for authorization and account creation, such as:

  • unique Google account identifier;
  • name;
  • email address;
  • profile image;
  • authorization tokens necessary for sign-in and session maintenance.

Minatrix.FM uses such data only for authorization, account creation or sign-in, account protection and communication with the User. The Service does not receive the User’s Google account password.

3.3. Profile Data and Public Activity

If the User completes their profile or publishes materials, the Service may process:

  • profile description;
  • links to social networks and music platforms;
  • information about artistic activity;
  • uploaded tracks, mixes, podcasts, images and descriptions;
  • genres, tags, explicit-language marks, marks indicating the use of artificial intelligence technologies;
  • comments, reactions, likes, votes, playlists, subscriptions and rating activity;
  • public pages created on the basis of the profile and uploaded content.

Some of this data may be available to other Users and visitors of the Service.

3.4. Messages and Communications

When using private messages, chats, comments, notifications and feedback forms, the Service may process:

  • message text;
  • attachments;
  • date and time of sending;
  • sender and recipient data;
  • delivery or read status;
  • reactions;
  • complaints and support requests.

Private messages are not public; however, the Operator may access them where necessary for technical support, investigation of violations, handling complaints, preventing fraud, protecting Users, complying with the law or ensuring the security of the Service.

3.5. Music Files, Images and Metadata

When music, cover artworks, avatars and other files are uploaded, the Service may process:

  • the file itself;
  • file name;
  • size, format, MIME type;
  • audio duration;
  • technical audio parameters;
  • waveform visualization;
  • ID3 tags and other embedded metadata;
  • upload date;
  • data of the account from which the upload was made;
  • information about moderation status, availability, complaints and restrictions.

The User must independently ensure that uploaded files do not contain unnecessary personal data or data of third parties, unless the User has the right to publish such data.

3.6. Payment Data and Paid Features

When using Premium features, promotion, internal bonuses, BPM or other paid functionality, the Service may process:

  • fact of payment;
  • payment date and time;
  • amount;
  • currency;
  • payment status;
  • transaction identifier;
  • selected service;
  • service validity period;
  • history of accruals and deductions within the Service.

Minatrix.FM does not store full bank card details. Payments may be processed through banks, payment systems, Google Play, App Store or other payment partners that process payment data under their own rules.

3.7. Technical Data

When the Service is used, the following data may be processed automatically:

  • IP address;
  • date and time of visit;
  • address of the requested page;
  • referral source;
  • device type;
  • device model;
  • operating system;
  • browser;
  • browser language;
  • session identifiers;
  • cookies;
  • data about actions on the Service;
  • errors, failures and diagnostic logs;
  • push notification tokens;
  • advertising or analytics identifiers, if used and permitted by device settings or law.

3.8. Mobile Application Data

When using the Minatrix.FM mobile application, the following data may be processed:

  • account data;
  • authorization token;
  • device push token;
  • technical information about the application version;
  • crash and diagnostic information;
  • notification settings;
  • information about listening activity and interaction with application features;
  • microphone access — only for voice messages, calls or other audio features, if the User enables such functionality themselves;
  • access to files, images or media library — only for selecting and uploading materials, if the User initiates such upload themselves.

The Service does not use the microphone, camera, files or notifications without the User’s permission at the device level where such permission is required by the operating system.

4. Purposes for Which Data Is Used

The Operator may use the User’s data for the following purposes:

4.1. Registration, authorization and account management.

4.2. Providing access to Service features.

4.3. Playback of online radio, music content and user-generated materials.

4.4. Uploading, storing, processing, publishing and displaying User Content.

4.5. Operation of profiles, comments, messages, notifications, playlists, ratings and social features.

4.6. Processing support requests.

4.7. Sending technical, service, informational and user notifications.

4.8. Providing paid features, Premium functionality, internal bonuses, BPM and promotional tools.

4.9. Preventing fraud, spam, artificial boosting, abuse, unauthorized access and other violations.

4.10. Content moderation, review of complaints, protection of the rights of Users, rights holders and third parties.

4.11. Compliance with legal requirements, court decisions, requests from competent authorities and rules of payment partners.

4.12. Analytics, statistics, interface improvement, bug fixing and Service development.

4.13. Personalization of the interface, language, recommendations, content display and advertising materials, where permitted by law and the User’s settings.

4.14. Protection of the rights and legitimate interests of the Operator.

5. Legal Grounds for Processing

Depending on the User’s country and the specific function of the Service, data processing may be carried out on the following grounds:

5.1. Performance of the User Agreement and provision of Service features.

5.2. The User’s consent, for example upon registration, use of cookies, receipt of notifications, sign-in through Google, upload of materials or enabling of certain application permissions.

5.3. The Operator’s legitimate interest, including Service security, fraud prevention, spam protection, analytics, improvement of service quality, protection of rights and handling of claims.

5.4. Compliance with the Operator’s legal obligations.

5.5. Protection of the rights of Users, the Operator, rights holders and third parties.

Where processing is based on consent, the User has the right to withdraw consent. Withdrawal of consent does not affect the lawfulness of processing carried out before such withdrawal.

6. Public Availability of Certain Data

6.1. The User understands that certain data posted by them on the Service may be public.

6.2. Public data may include:

  • name or nickname;
  • avatar;
  • profile description;
  • links to social networks;
  • uploaded tracks, mixes, podcasts, cover artworks and descriptions;
  • comments;
  • likes, reactions, votes and rating activity, where provided by the interface;
  • public playlists;
  • status as an artist, DJ, rating participant or author of material.

6.3. The User must not publish personal data of third parties without their consent.

6.4. Deleting an account or content may not result in the immediate removal of all traces of public activity from search engines, caches, copies held by other users or third-party services that are not controlled by the Operator.

7. Cookies and Similar Technologies

7.1. The Service may use cookies, localStorage, sessionStorage, pixels, device identifiers and similar technologies.

7.2. Such technologies may be used for:

  • authorization and session retention;
  • account security;
  • remembering language, theme and settings;
  • operation of the audio player;
  • traffic analytics;
  • measuring the effectiveness of pages and features;
  • preventing spam and abuse;
  • displaying advertising and limiting the frequency of its display;
  • personalizing advertising, where permitted by law and the User’s settings.

7.3. The User may restrict or delete cookies in browser settings. Some Service features may then function incorrectly.

7.4. If the laws of the User’s country require prior consent for analytics, advertising or other non-essential cookies, such cookies must be used only after the relevant consent has been obtained.

8. Google Analytics, Google Ads, AdSense and Other Google Services

8.1. The Service may use Google Analytics or similar analytics tools to understand how Users interact with the website and application.

8.2. Google Analytics may collect technical data, cookies, device identifiers, information about visits, events, referral sources and interface interactions.

8.3. The Service may use Google Ads, Google AdSense, Google AdMob or other Google advertising technologies.

8.4. Third-party providers, including Google, may use cookies to display advertising based on the User’s previous visits to Minatrix.FM or other websites.

8.5. Google and its partners may use advertising cookies to display personalized or non-personalized advertising.

8.6. The User may manage advertising personalization in their Google account settings and browser or device settings.

8.7. The Operator must not transmit to Google Analytics information that allows Google to directly identify the User if such transmission is prohibited by Google Analytics rules.

8.8. The use of Google services is also governed by Google’s policies and terms.

9. Authorization Through Google

9.1. If the User chooses to sign in through Google, Minatrix.FM receives only the data necessary for authorization and account creation.

9.2. Usually, this includes name, email address, profile image and unique Google account identifier.

9.3. Minatrix.FM does not receive the User’s Google account password.

9.4. Data received through Google Sign-In is used for:

  • signing in to the account;
  • creating a profile;
  • protecting the account;
  • communicating with the User;
  • preventing duplicate accounts and abuse.

9.5. Minatrix.FM does not sell data received through Google Sign-In, does not use it for hidden profiling, does not transfer it to third parties for their own marketing, and does not use such data for purposes unrelated to authorization, account security and the operation of user-facing Service features.

9.6. The use and transfer of information received by Minatrix.FM through Google APIs is carried out in accordance with the Google API Services User Data Policy, including the Limited Use requirements. Data received through Google APIs is used only to provide or improve user-facing Service features visible to the User and is not used for sale, hidden advertising, unauthorized transfer or other purposes prohibited by Google rules. Google expressly states that the use of Google API data must comply with the Limited Use requirements.

10. Push Notifications

10.1. The Service may send push notifications about messages, calls, account notifications, activity, important changes or other events.

10.2. Firebase Cloud Messaging or a similar service may be used to send push notifications.

10.3. For push notifications to function, the device token, account identifier, notification type, date and time of sending may be processed.

10.4. The User may disable push notifications in the application, browser or device settings.

11. Calls, Voice Messages and Audio Features

11.1. If the User uses voice messages, calls or other audio features, the application or website may request access to the microphone.

11.2. Microphone access is used only for the feature that the User enables or launches themselves.

11.3. Voice messages may be stored on the Service as message attachments.

11.4. Calls may be technically processed to establish a connection, transmit audio, display call status and ensure security.

11.5. The Operator does not state that call recording is a standard feature of the Service. If such a feature is added, Users must be notified separately.

12. Transfer of Data to Third Parties

The Operator may transfer or disclose data only where necessary for the operation of the Service, compliance with the law or protection of rights.

Such recipients may include:

12.1. Hosting providers, server and infrastructure providers.

12.2. Payment systems, banks, Google Play, App Store and other payment partners.

12.3. Authorization services, including Google.

12.4. Analytics, advertising and performance measurement services, including Google Analytics, Google Ads, AdSense, AdMob or similar tools, if used.

12.5. Push notification, diagnostics, error monitoring and abuse protection services.

12.6. Contractors and technical specialists who help maintain the Service and are required to maintain confidentiality.

12.7. Rights holders, where necessary to review a complaint concerning copyright or related rights infringement.

12.8. Government authorities, courts, law enforcement agencies or other authorized persons, where disclosure is required by law or necessary to protect rights.

12.9. Other Users and visitors of the Service — with respect to data that the User has made public themselves.

13. Cross-Border Data Transfers

13.1. Minatrix.FM may be accessible to Users from different countries.

13.2. Data may be stored and processed on servers located in the Operator’s country, countries of the European Union, the United States or other countries where infrastructure, analytics, advertising, authorization, payment or technical support providers are located.

13.3. In the event of cross-border data transfers, the Operator takes reasonable measures to protect data and uses transfer methods that are necessary for the operation of the Service and are not prohibited by applicable law.

14. Data Retention

14.1. Account data is stored while the account remains active or for as long as necessary to provide the Service.

14.2. Public content is stored until it is deleted by the User or Administration, or until the relevant function is discontinued.

14.3. Messages and attachments are stored until deletion within the functionality of the Service, account deletion, or expiration of technical and legal retention periods.

14.4. Technical security logs may be stored for the period necessary to prevent abuse, investigate incidents, protect rights and ensure stable operation of the Service.

14.5. Backup copies may retain certain data for a limited technical period after deletion from the main database.

14.6. Data related to payments, transactions, claims, violations, blocking, complaints, security and legal obligations may be stored for a longer period if necessary to comply with the law, accounting requirements, dispute resolution, fraud prevention or protection of rights.

14.7. Once the purposes of processing have been achieved, data is deleted, depersonalized or archived, unless further storage is required on lawful grounds.

15. Account and Data Deletion

15.1. The User has the right to request deletion of their Minatrix.FM account and related personal data.

15.2. A request for account deletion may be submitted by contacting Minatrix.FM support at support@minatrix.fm, as well as through the available “Delete Account” option in the profile settings or mobile application, if the User is signed in to the account.

15.3. For Users who have already deleted the application, lost access to the application or are unable to sign in to their account, the Service provides a separate public web page with instructions for deleting the account and submitting a request. This page is available without installing the application and without mandatory authorization.

15.4. To submit a request, the User must send a request from the email address associated with the account or provide other information allowing confirmation of account ownership.

15.5. The request should preferably include:

  • login or account ID;
  • email address associated with the account;
  • a request to delete the Minatrix.FM account;
  • additional information that may help confirm account ownership.

15.6. After receiving and confirming the request, the Operator deletes or depersonalizes the account and related personal data within 30 calendar days, except for data that must be retained for a longer period on legal, technical or rights-protection grounds.

15.7. Account deletion may result in loss of access to the profile, uploaded materials, messages, playlists, settings, Premium features, internal bonuses, BPM, activity history and other data associated with the account.

15.8. Together with the account, the following may be deleted or depersonalized:

  • profile data;
  • email address;
  • avatar and profile images;
  • account settings;
  • user-generated materials, if their further storage is not required;
  • messages and attachments, if their deletion does not violate the rights of other users and is not required for complaint handling;
  • technical identifiers associated with the account;
  • device push tokens;
  • Google Sign-In data associated with the Minatrix.FM account.

15.9. The Operator may retain certain data after account deletion if necessary for:

  • compliance with legal requirements;
  • accounting, payment or tax records;
  • processing payments, refunds and disputed transactions;
  • protection against fraud, spam, artificial boosting and abuse;
  • investigation of violations of the User Agreement;
  • review of complaints from users or rights holders;
  • protection of the rights and legitimate interests of the Operator, Users or third parties;
  • compliance with court, governmental or law enforcement requests;
  • operation of backup copies for the technically necessary period.

15.10. Data retained after account deletion on the above grounds is not used for ordinary account activity and is stored only to the extent and for the period necessary for the relevant purpose.

15.11. Account deletion does not guarantee immediate removal of information from search engines, caches, archives, copies held by other users, third-party websites or services that are not controlled by the Operator.

15.12. If the User wishes to delete only certain data rather than the entire account, they may specify this in their request to support. The Operator will review such request within the technical capabilities of the Service and the requirements of applicable law.

16. User Rights

Depending on applicable law, the User may have the following rights:

16.1. To obtain information about what data is being processed.

16.2. To request a copy of their data.

16.3. To correct inaccurate or outdated data.

16.4. To delete the account or specific data.

16.5. To withdraw consent to data processing, where processing is based on consent.

16.6. To restrict data processing in cases provided by law.

16.7. To object to data processing, where such possibility is provided by law.

16.8. To request data portability, where applicable.

16.9. To disable advertising, analytics or push settings, where such option is available.

16.10. To lodge a complaint with a competent personal data protection authority if the User believes that their rights have been violated.

To exercise their rights, the User may contact support@minatrix.fm.

17. Data Security

17.1. The Operator takes reasonable technical and organizational measures to protect data against unauthorized access, alteration, disclosure, loss or destruction.

17.2. Such measures may include:

  • use of a secure connection;
  • restriction of access to data;
  • user authorization;
  • technical separation of access rights;
  • storage of passwords in a protected form;
  • backup copying;
  • monitoring of errors and suspicious activity;
  • anti-spam and anti-fraud mechanisms;
  • software updates;
  • internal rules for access to administrative functions.

17.3. Despite the measures taken, no internet service can guarantee absolute data security. The User is also required to observe security measures: use a strong password, not transfer account access to third parties and promptly report suspicious activity.

18. Data of Minors

18.1. The Service is not intended for the intentional collection of personal data from children below the age at which they may independently use online services under the laws of their country.

18.2. If the User has not reached the required age, they may use the Service only with the consent of a legal representative, where permitted by law.

18.3. If the Operator becomes aware that data of a minor has been provided without the required consent, the Operator may delete such data or restrict the account.

18.4. A parent or legal representative may contact support@minatrix.fm to request deletion of a minor’s data.

19. Third-Party Websites and Services

19.1. The Service may contain links to third-party websites, social networks, music platforms, advertising networks, payment systems, app stores and other resources.

19.2. The Operator does not control the privacy policies or actions of third-party services.

19.3. By visiting third-party websites or using third-party services, the User independently accepts their terms and privacy policies.

20. Processing of Data of Rights Holders and Applicants

20.1. If a rights holder, representative, user or other person submits a complaint, claim, DMCA request or inquiry, the Operator may process the data specified in such submission.

20.2. Such data may include name, organization, contact address, email address, information about rights, links to materials, description of the claim and attached documents.

20.3. This data is used to review the submission, communicate with the applicant, take measures regarding disputed content and protect the rights of the Operator, Users and third parties.

21. Changes to the Policy

21.1. The Operator has the right to amend this Policy.

21.2. A new version becomes effective from the moment it is published on the Service, unless another effective date is specified in it.

21.3. Continued use of the Service after publication of the new version means that the User has read the updated Policy.

21.4. If changes materially affect Users’ rights or the procedure for data processing, the Operator may additionally notify Users by an available means.
